This is a translation for convenience. The Armenian version is legally binding.
Effective from 21 October 2026.
This document is the public offer of ABAPharm (the “Seller”) within the meaning of Articles 453 and 510 of the Civil Code of the Republic of Armenia for the sale of medicines and other pharmacy products through www.abapharm.am (the “Website”). By pressing the “Order with obligation to pay” button, the buyer (the “Buyer”) accepts these terms in full and without reservation, and a distance retail sale contract is concluded between the Seller and the Buyer on these terms.
The Returns and refunds rules, the Privacy policy and the Delivery and Payment methods pages form an integral part of these terms. In the event of a conflict, these terms and the Returns and refunds rules prevail.
1. Seller
- Seller: ABAPharm pharmacy chain
- Place of business and address for written claims: 59/5 Karapet Ulnetsi St, Yerevan
- Pharmacy activity: carried out under a license issued in accordance with Armenian law (see the License page)
- Phone: +374 10 202032 (daily 9:00–24:00); email: info@abapharm.am
2. Buyer and account
- Orders may be placed only by persons aged 18 or over with full legal capacity, for personal, family or household needs. Products are not sold for resale or other business purposes.
- Orders may be placed with an account or as a guest. The Buyer is responsible for keeping the login details confidential and for all actions taken through the account.
- The Buyer must provide accurate, complete and current data (name, phone number, delivery address) and remain reachable on the phone number given until the order is handed over. The Seller is not responsible for the consequences of inaccurate or incomplete data or of the Buyer being unreachable.
- Notices sent by the Seller to the phone number or email address given by the Buyer are deemed received.
- The Seller may suspend or block an account and refuse further orders where the Website is used for fraud, abuse or resale, or in breach of these terms.
3. Products, prices and product information
- Product names, descriptions and images are provided by manufacturers and suppliers and are for information only. The appearance and packaging of a product may differ from its image. The information on the product packaging and in the package leaflet prevails. To the extent permitted by law, the Seller is not liable for the accuracy of information provided by manufacturers.
- Stock levels and delivery times shown on the Website are indicative and not guaranteed. Availability is confirmed only when the pharmacist approves the order.
- Prices are in Armenian drams (AMD) and include applicable taxes. The Seller may change prices, the assortment and the delivery terms at any time without notice. An order already placed is performed at the price shown on the Website when it was placed.
- If a price or product information contains an obvious error, the Seller may cancel the order before approval and refund any amount paid in full, or offer the Buyer the corrected terms.
- Where permitted by law and stated on the product page, certain medicines may be sold by the unit (for example, by the blister).
4. Not medical advice
- Information given on the Website, in emails, in chat and by the pharmacist in connection with an order is general information. It is not medical advice, a diagnosis or a prescription and does not replace consulting a doctor.
- The Buyer alone is responsible for choosing a medicine, for using it in accordance with the package leaflet and the doctor’s instructions, and for checking contraindications, interactions and suitability for the person who will use it. The Seller is not liable for the consequences of self-medication or of use contrary to the package leaflet or the doctor’s instructions.
5. Prescription medicines
- Under Article 25 of the RA Law on Medicines and RA Government Decision No. 1256-N of 8 November 2018, prescription medicines are dispensed only against a valid prescription and may be delivered only where an electronic prescription exists.
- Before approving an order that contains a prescription medicine, the pharmacist checks the electronic prescription issued in the patient’s name. If there is no valid electronic prescription, the order is declined and any amount paid is refunded in full.
- Medicines containing narcotic drugs or psychotropic substances are not sold through the Website and are not delivered.
- As required by law, the pharmacist informs the Buyer about interchangeable medicines available in the pharmacy and their prices. The choice is made by the Buyer.
6. Ordering and approval
- The Buyer selects the products, enters the order data, chooses the payment method, checks the total (including the delivery fee) and presses the “Order with obligation to pay” button. Pressing that button creates the Buyer’s obligation to pay for the order.
- The contract is concluded when the order is placed. Receipt of the order is confirmed on screen and, if an email address was given, by email. Confirmation of receipt is not approval of the order.
- Every order is checked by a pharmacist (availability, expiry dates, quantities and, where required, the prescription). Approval is at the pharmacist’s professional discretion. Only an approved order is prepared and handed over for delivery.
- If stock is insufficient, the Seller may propose to perform the order in a reduced quantity or without certain products, stating the new total. The Buyer may accept or refuse the proposal within 48 hours; the Seller may extend this period. If no answer is received within that period, the order is cancelled automatically and any amount paid is refunded in full. A changed order is performed only with the Buyer’s acceptance.
- Before approval, the Seller may decline or cancel an order in whole or in part, in particular where: the product is out of stock; the price or product information was incorrect; a required prescription is missing or invalid; the delivery address is outside Yerevan; the Buyer cannot be reached or has given inaccurate data; there are signs of fraud, resale or a quantity exceeding reasonable personal use; the order exceeds the quantity limits set by the Seller; or the Buyer has previously refused an order without a legal reason. Any amount paid for a declined or cancelled order is refunded in full.
- The Seller may set limits on the quantity of a product per order or per Buyer.
7. Payment
- Cash on delivery: the Buyer pays the courier on receipt of the order and receives a cash register receipt or another payment document required by law.
- Online payment (when available on the Website): by bank card (ArCa, Visa, Mastercard) on the bank’s secure payment page, or through Idram. The methods available at a given time are shown at checkout.
- Card details are entered only on the bank’s page; the Seller does not receive or store card numbers.
- An online payment must be completed within 30 minutes of placing the order; otherwise the order is cancelled automatically. A payment received after cancellation is refunded.
- Amounts due to the Buyer are refunded to the same payment method, in accordance with the Returns and refunds rules.
- Fees charged by the Buyer’s bank or payment system (including currency conversion) are borne by the Buyer.
- The Seller may require prepayment or refuse cash on delivery for a particular order or Buyer, in particular where the Buyer has previously refused an order without a legal reason or failed to receive it through the Buyer’s own fault.
8. Delivery and handover
- Delivery is made within Yerevan only. The delivery fee is 1,000 AMD per order.
- Delivery hours: Monday to Saturday 9:00–21:00, Sunday 10:00–18:00. Orders approved outside these hours are delivered on the next delivery day. The phone line operates daily 9:00–24:00.
- The delivery time is agreed when the order is approved and is approximate. A delay caused by traffic, weather, actions of third parties or other circumstances beyond the Seller’s control is not a breach of contract. The time limits set by Article 24.10 of the RA Law on Consumer Rights Protection apply.
- Medicines are delivered in undamaged consumer packaging in compliance with their storage conditions; temperature-sensitive medicines are delivered in insulated packaging.
- The Buyer must ensure that the order is received at the agreed address and time. The order may be handed to the Buyer or to an adult present at the delivery address who accepts it; handover to that person is handover to the Buyer. The courier may refuse to hand over an order to a person under 18.
- On receipt and in the presence of the courier, the Buyer must check the products, quantities, packaging integrity and expiry dates and immediately report any visible damage, shortage or wrong product to the courier. Claims concerning visible damage, shortages or wrong products that could have been detected by such a check but were not raised at handover may be refused. This does not apply to claims for hidden defects that cannot be detected by ordinary inspection.
- The risk of accidental loss of or damage to the goods passes to the Buyer at the moment of actual receipt.
Failed delivery
- If the order cannot be handed over through the Buyer’s fault (the Buyer is unreachable or absent, the address is wrong or incomplete, or the Buyer refuses the order without a legal reason), repeat delivery is charged at 1,000 AMD.
- If the Buyer does not respond within 24 hours after one failed delivery attempt, the Seller may cancel the order. For a prepaid order, the Seller may, to the extent permitted by law, withhold the delivery fee from the refund as a necessary expense.
- If a cash-on-delivery order is refused without a legal reason, the Seller may refuse the Buyer’s future cash-on-delivery orders or require prepayment.
9. Cancellation by the Buyer
The Buyer may cancel an order only until it is approved by the pharmacist, by calling +374 10 202032. Any amount paid online is then refunded. After approval the order is prepared for the Buyer and is not cancelled. Where the law entitles the Buyer to refuse the goods before handover (Article 513(3) of the RA Civil Code), the Buyer reimburses the Seller’s necessary expenses, including the delivery fee. The statutory right to withdraw from the purchase of non-medicine products after delivery is governed by the Returns and refunds rules.
10. Returns, quality and claims
- Under Article 25(7) of the RA Law on Medicines, medicines of proper quality are not exchanged or accepted back.
- The Buyer may withdraw from the purchase of non-medicine products within 14 days of receipt under Article 24.4 of the RA Law on Consumer Rights Protection, subject to the conditions and exceptions set by law.
- Claims concerning defective, expired, damaged or wrong products are handled as the law provides.
- The conditions and procedure are set out in the Returns and refunds rules. Returns or exchanges not provided for by those rules or by law are not accepted.
11. Liability
- The Seller is liable for the quality of the products sold and for performing the contract in accordance with Armenian law.
- To the extent permitted by law, the Seller is not liable for:
- indirect or consequential loss or lost profit;
- the consequences of using a product contrary to the package leaflet or the doctor’s instructions, of self-medication, or of improper storage of the product after handover;
- the consequences of inaccurate or incomplete data given by the Buyer;
- information provided by manufacturers;
- delay or non-performance caused by force majeure, traffic, weather, failures of communication or payment systems, or actions of third parties.
- To the extent permitted by law, the Seller’s total liability in connection with an order is limited to the price of the product concerned.
- These limitations do not apply to harm to life or health caused by a defect of the product or to other cases in which the law does not permit liability to be limited, and they do not restrict consumer rights that cannot be excluded by contract.
12. Personal data
Personal data are processed in accordance with the RA Law on Protection of Personal Data and the Privacy policy. By placing an order, the Buyer confirms that any data of the recipient or patient have been provided lawfully.
13. Website content
The content of the Website (texts, design, logo, product database) belongs to the Seller or the respective rights holders. Copying, automated collection or commercial use of it without the Seller’s written consent is prohibited.
14. Amendments
The Seller may amend these terms at any time by publishing a new version on the Website with its effective date. Using the Website or placing an order after publication constitutes acceptance of the new version. Each order is governed by the version in force when it was placed.
15. Claims, disputes and governing law
- These terms are governed by the law of the Republic of Armenia.
- The Buyer first submits a written claim to the Seller at info@abapharm.am or at the address in section 1, stating the order number and the substance of the claim and attaching supporting documents. The Seller replies within 10 days of receipt.
- If the claim is not resolved, the Buyer may apply to the Commission for the Protection of Competition and Consumer Interests, and the dispute is settled by the competent court of the Republic of Armenia in Yerevan, unless the law entitles the Buyer to choose another court. This section does not restrict the Buyer’s right of recourse to that Commission or to a court as provided by law.
